1. Agreement to Terms

By accessing or using TulipTech's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

2. Services Description

TulipTech provides custom software development, mobile app development, AI/ML solutions, cloud services, and related technology consulting services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information for project requirements
  • Respond to communication requests in a timely manner
  • Provide necessary access to systems, documentation, and resources
  • Make payments according to agreed-upon terms
  • Respect intellectual property rights and confidentiality agreements

4. Intellectual Property

Upon full payment, clients receive ownership of custom-developed code and deliverables specifically created for their project. TulipTech retains ownership of pre-existing frameworks, tools, libraries, and general methodologies. We reserve the right to use non-confidential project experience as portfolio examples.

5. Payment Terms

Payment terms are outlined in individual project agreements. Typical payment structures include milestone-based payments or monthly retainers. Late payments may result in project suspension and interest charges as permitted by law.

6. Confidentiality

TulipTech agrees to maintain the confidentiality of proprietary client information. We will not disclose confidential information to third parties except as necessary to perform services or as required by law. Both parties agree to sign separate Non-Disclosure Agreements (NDAs) when appropriate.

7. Warranties and Disclaimers

We warrant that services will be performed in a professional manner consistent with industry standards. However, we do not guarantee that software will be error-free or uninterrupted. TulipTech is not liable for indirect, incidental, or consequential damages arising from the use of our services.

8. Limitation of Liability

TulipTech's total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific services giving rise to the claim.

9. Project Timelines

Estimated timelines are provided in good faith but are not guaranteed. Delays caused by client actions, third-party services, or unforeseen circumstances may extend project timelines without penalty to TulipTech.

10. Termination

Either party may terminate a project agreement with written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. TulipTech will provide all work products completed and paid for at the time of termination.

11. Support and Maintenance

Post-launch support and maintenance services are available under separate agreements. Warranty periods for bug fixes are specified in individual project contracts.

12. Governing Law

These terms shall be governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, Netherlands.

13. Changes to Terms

TulipTech reserves the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of modified terms. Material changes will be communicated to active clients.
